1. Release of Liability

Clients agree to participate in activities provided by Nebraska Party and Play at their own risk. Nebraska Party and Play is not liable for any injuries, accidents, or damages that may occur during the event. By using our services, clients release Nebraska Party and Play, its owners, employees, and affiliates from any claims arising from participation.

2. Assumption of Risk

Clients acknowledge that soft-play activities involve physical movement and assume all risks associated with participation. Parents/guardians understand that they are responsible for supervising their children during playtime.

3. Parental/Guardian Supervision

Nebraska Party and Play is not responsible for monitoring children’s behavior or ensuring their safety. Parents/guardians must supervise their children at all times to prevent accidents or injuries.

4. Health & Wellness Policy

Participants must be free of illness, including but not limited to fever, contagious diseases, or infections, at the time of the event. Nebraska Party and Play reserves the right to refuse participation to anyone showing signs of illness.

5. Food Allergy Disclaimer

Nebraska Party and Play provides party food but cannot guarantee an allergen-free environment. Clients are responsible for disclosing any food allergies or dietary restrictions in advance.

6. Deposit Policy

A non-refundable deposit is required to secure a booking with Nebraska Party and Play. The deposit amount is 50% of the total amount due. Deposits cannot be refunded but may be transferable to another date, subject to availability.

7. Booking and Cancellation

Bookings are confirmed upon receipt of the non-refundable deposit. Cancellations made 14 days prior to the event may be eligible for rescheduling, subject to availability. Cancellations made within 7 days of the event are non-refundable and non-transferable.

8. Use of Pictures for Marketing

Nebraska Party and Play reserves the right to photograph or record events for marketing and social media purposes. By participating in our services, clients grant Nebraska Party and Play permission to use such images without compensation.

9. Equipment Use Policy

Participants must use all play equipment as intended. Misusing equipment is strictly prohibited. Clients are financially responsible for damage caused by negligence or misuse of play structures.

10. Waiver of Claims

Clients waive any and all claims against Nebraska Party and Play, its owners, employees, or affiliates for injuries, damages, or losses incurred while using the facilities or services.

11. Conduct and Responsibilities

Clients are responsible for the conduct of all participants during the event. Any damage to equipment or facilities due to negligence or misuse will be charged to the client.

12. Payment Terms 

The remaining balance is due 14 days before the scheduled event date. Payments can be made via most major credit cards or Venmo @nebraskapartyandplay

13. Safety Regulations

Clients must adhere to all safety guidelines and instructions provided by Nebraska Party and Play staff. Proper attire, behavior, and supervision of children are the responsibility of the client.

14. Force Majeure (Uncontrollable Events)

Nebraska Party and Play is not liable for cancellations or service interruptions due to circumstances beyond its control, such as severe weather, natural disasters, or government-mandated closures.

15. Amendments to Agreement

Nebraska Party and Play reserves the right to amend these terms with reasonable notice to clients. Continued use of services after amendments constitutes acceptance of the revised terms.

16. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the state of Nebraska.

17. Acknowledgment of Terms

Clients must sign or electronically agree to these terms before participation in any event. By signing, clients confirm they have read, understood, and agreed to all terms.
